Consumers shall be bound by the General Terms and Conditions valid at the time of purchase or when placing an online order.

The General Terms and Conditions of the cubegolem.si online store define the terms of purchase and sale of products provided by KROCOM, d.o.o., Brežice, Opekarska ulica 16, SI – 8250 Brežice, Slovenia. These terms have been drawn up in accordance with the Consumer Protection Act (ZVPot) and international e-commerce regulations. The cubegolem.si online store is an information system intended for presenting and selling products to users. It is managed by KROCOM, d.o.o., Brežice. The user is the person who uses our system, i.e., the buyer at the cubegolem.si online store.

KROCOM, d.o.o., Brežice, and the user/buyer regulate their mutual obligations when making purchases via the cubegolem.si online store with these General Terms and Conditions. All registered users of the cubegolem.si online store have a username and password with which they identify themselves. The password specified by the user is confidential and known only to them. The user is obliged to ensure that only they, or a person authorized to act on their behalf, will use their password.

These General Terms and Conditions regulate the operation of the cubegolem.si online store, user rights, and the business relationship between the seller and the user/buyer.

ACCOUNT REGISTRATION

After registering at www.cubegolem.si and having your account approved, you become a member of the Cube Golem online store (owned by KROCOM, d.o.o. Brežice). The right to purchase at the Cube Golem (hereinafter cubegolem.si ) online store is granted to registered members only.

During registration in the online store, the user creates login credentials (email and password), enters the billing address and contact details, and uploads all required documentation. The displayed username will be linked to the company specified in the billing address.

Upon successful registration, the user will be assigned an account manager who will verify the submitted information. Account activation is subject to approval by the Cube Golem team.

Once the account is activated, the user may change their password and add new delivery addresses at any time. Each newly added delivery address must be additionally approved by the Cube Golem team before use. For all other changes, the user must contact their assigned account manager.

INFORMATION AVAILABILITY

KROCOM, d.o.o. Brežice undertakes to provide the consumers with the following information:

• Identity of the company (name and registered office, registration number, and VAT/tax number)
• Contact details allowing quick and efficient communication (email address, telephone number)
• Key characteristics of products or services
• Availability of products (every product offered on the website shall be available within a reasonable period of time, except for products in the “PREORDERS / BACKORDERS” section, the policy of which is explained in that section)
• Method of payment
• Prices of the products (all listed prices are excluding VAT)
• Complaint procedure

PRODUCT OFFER AND PRICES

Due to the nature of e-commerce, the product offer and prices at cubegolem.si are subject to frequent updates and stock changes. All product prices include/exclude VAT according to the law. Since we do business exclusively with business entities, product prices do not include VAT for easier perception of the net price. In accordance with ZDDV-1 (Value Added Tax Act), the final price is shown both with and without VAT. The prices are valid from the moment the order is placed (exceptions are products with the “PREORDER” and “BACKORDER” options, the policy of which is explained in the “PREORDERS / BACKORDERS” section) and do not have a predetermined validity period.

ORDERING AND PRICES

The consumer contract between KROCOM, d.o.o. Brežice, and the buyer on cubegolem.si is concluded at the moment KROCOM, d.o.o. Brežice (cubegolem.si) sends the buyer an order confirmation, proforma invoice, or original invoice via email or any other agreed method (exceptions are “PREORDER” and “BACKORDER” products, the policy of which is explained in the “PREORDERS / BACKORDERS” section). From that moment on, all prices and other conditions are considered fixed and binding for both the company and the buyer.

PREORDERS / BACKORDERS

KROCOM, d.o.o. Brežice (cubegolem.si) also offers the option of Preorders and Backorders for certain products. When placing a Preorder or Backorder, you guarantee that all your information about the company is accurate and up-to-date. KROCOM, d.o.o. Brežice assumes no responsibility for inaccurate information and is not obliged to correct or verify contact details. If you wish to update your information, please contact your account manager.

All submitted preorders are considered binding and may not be cancelled after the preorder deadline.

If you have mistakenly placed a preorder and the order deadline has already passed, please contact your account manager immediately.

Products with the Preorder option are treated separately, subject to the following business policy:

• Allocations by manufacturers may consider the dates of Preorders and Backorders, so it is recommended to submit them within relevant deadlines (before the “Order Deadline”).
• Preorders do not guarantee the receipt of products, even if submitted before the deadline.
• Product offers and prices are subject to change, and KROCOM, d.o.o. Brežice reserves the right to adjust prices due to increases from suppliers or manufacturers.
• When placing a Preorder or Backorder, payment is not required unless otherwise agreed in writing.
  
  Customers can check or modify their Preorders anytime before the order deadline in their account section under "Your Preorders." After the deadline, modifications are no longer possible.

BACKORDERS are products that are currently not in stock. These items are expected to be delivered in the future, but delivery dates and the actual delivery are not guaranteed. Customers can check or modify their Backorders anytime in their account under "Your Backorders."

Cube Golem (KROCOM, d.o.o. Brežice) reserves the right to change any of the terms for any reason or no reason.

SHIPPING

KROCOM, d.o.o. Brežice is not responsible for any additional costs (such as taxes, customs duties, or other import fees) that may arise during the shipping process.

Shipping costs depend on the delivery location. For companies based in the EU, shipping is managed by KROCOM, d.o.o. Brežice, and a free shipping threshold—unless otherwise agreed—is available depending on the destination country.

For non-EU companies, KROCOM, d.o.o. Brežice does not guarantee shipping services. In such cases, customers may be required to arrange their own pickup and transport.

DISCOUNTS

Discounts offer various benefits when shopping at cubegolem.si. They are either tied to a specific user or globally among certain products. Please note that if a certain product would have multiple discounts, they DO NOT add up and ONLY the largest applies (e.g. if a user has 5% discount on all products and a certain product has a 10% global discount for all users, purchasing that product would apply 10% discount).

PURCHASING PROCESS

The purchasing process is the same for all registered users, with possible special arrangements. The system is user-friendly and guides the buyer through the order process.

PURCHASE NOTIFICATION PROCEDURE

After placing an order, users can view the order details in their profile under the "Account" section. An automatic confirmation email with an order summary will be sent to the provided email address.

Once the account manager reviews the order and confirms the quantities, the order moves to the next stage—packaging. If the user does not have available or approved credit limit, a proforma invoice (visible in the "Account" section) will be issued and must be paid before packaging begins.

All users have access to an overview of all their orders and issued invoices in their profile (under the "Account" section), where they can also track the status of their orders.

To ensure delivery accuracy, the user may be contacted via the provided email address or phone number. Further communication will take place via email or another agreed-upon method.

CREDIT LIMIT

The term "Credit Limit" refers to the maximum amount of credit available to the user for purchasing products within a specified time period. This limit is determined based on various factors, such as payment performance and order frequency.

The credit limit can be used across multiple orders; however, once the threshold is exceeded or the due date is reached, new orders will no longer be shipped in advance until the outstanding invoices are settled.

Upon registration, the assigned account manager will determine the credit limit (if applicable) and the payment terms (due days).

FAST PAYMENT DISCOUNT

Users with an enabled credit limit may be eligible for fast payment benefits.

A discount will be applied to the total invoice amount if full payment is received within a specified period from the invoice date. To qualify for this discount, payment must be made within the defined time frame; the discount does not apply to late payments, partial payments, or payments made after the due date.

Please note that any adjustments, returns, or credits made after payment will result in a recalculation of the discount, and the revised invoice amount will reflect the updated balance.

The fast payment discount cannot be combined with other promotions or discounts unless expressly agreed upon in writing.

The discount amount and time frame are determined individually by the user’s assigned account manager.

RETURNS AND CLAIMS

Returns are accepted only in cases where the error is on our side. For any claims, please contact your assigned account manager.

LEGAL NOTICE

Cubegolem.si and all its content, including product images, graphics, and video elements, are protected and cannot be reproduced or used without the prior written permission of KROCOM, d.o.o. Brežice.

LIMITATION OF LIABILITY

Cubegolem.si strives to ensure the accuracy and timeliness of the information on the website, but changes in product characteristics, delivery times, or prices can occur quickly, making real-time updates difficult. In such cases, cubegolem.si will notify the consumer of the changes and allow them to withdraw from the contract or change the order.

Cubegolem.si is not responsible for the content of product reviews written by website visitors. Reviews containing obvious untruths, inappropriate, misleading, or offensive content will be reviewed and rejected. Cubegolem.si disclaims any liability arising from the information provided in the reviews.

Cubegolem.si may withdraw from the contract if a significant error is discovered (Article 46 of the Code of Obligations - OZ), such as errors related to product characteristics or pricing mistakes.

EXCLUSION OF LIABILITY

KROCOM, d.o.o. Brežice reserves the right to disable the website or restrict access due to technical issues or maintenance, which may also hinder the use of the online store. In the case of technical problems, KROCOM, d.o.o. Brežice may cancel orders that were affected by a technical error. Buyers will be informed of the cancellation and the procedure for such cases.

Buyers are obliged to provide appropriate software protection (antivirus, etc.) on their electronic device before accessing and using the online store. They must also protect the data they use to log into the website (email address and password). Buyers shall guarantee the accuracy and authenticity of all information transmitted and shall be liable to the company KROCOM, d. o. o. Brežice, for any damage incurred by inaccurate or false information.

COMPLAINTS AND DISPUTE SETTLEMENT

Cubegolem.si shall adhere to the applicable consumer protection legislation. Cubegolem.si shall make every effort to fulfill its obligation of setting up an effective complaint handling system.

In the event of problems, consumers can contact cubegolem.si. The complaint should be submitted via email address info@cubegolem.si. This procedure is confidential.

Cubegolem.si is aware that the key characteristic of consumer disputes is the disproportion between the economic value of a claim and the time required and the costs incurred in resolving the dispute, which is also the major factor preventing the consumers from bringing a dispute before the court. This is why cubegolem.si strives to the best of its ability to resolve potential disputes consensually.

Splošni pogoji poslovanja spletne trgovine cubegolem.si določajo pogoje nakupa ter prodaje izdelkov, ki jo izvaja podjetje KROCOM, d. o. o. Brežice, Opekarska ulica 16, SI – 8250 Brežice, Slovenija. Splošni pogoji poslovanja spletne trgovine cubegolem.si so sestavljeni v skladu z Zakonom o varstvu potrošnikov (ZVPot) in mednarodnimi kodeksi e-poslovanja. Spletna trgovina cubegolem.si je informacijski sistem, namenjen predstavitvi in prodaji izdelkov uporabnikom. Upravlja jo podjetje KROCOM, d. o. o. Brežice. Uporabnik je oseba, ki uporablja naš sistem, torej kupec v spletni trgovini cubegolem.si.

KROCOM, d. o. o. Brežice in uporabnik/kupec urejata medsebojne obveznosti pri nakupih prek spletne trgovine cubegolem.si s temi splošnimi pogoji. REGISTRACIJA RAČUNA

Ob registraciji v spletni trgovini uporabnik ustvari prijavne podatke (e-poštni naslov in geslo), vnese naslov za izstavitev računa ter kontaktne podatke, in naloži vso zahtevano dokumentacijo. Prikazano uporabniško ime bo vezano na podjetje, navedeno v naslovu za izstavitev računa.

Po uspešno opravljeni registraciji bo uporabniku dodeljen skrbnik računa, ki bo preveril vnesene podatke. Aktivacija uporabniškega računa je pogojena z odobritvijo s strani ekipe Cube Golem.

Po aktivaciji računa lahko uporabnik kadarkoli spremeni svoje geslo ter doda nove naslove za dostavo. Vsak novo dodan naslov za dostavo mora biti pred uporabo dodatno odobren s strani ekipe Cube Golem. Za vse ostale spremembe mora uporabnik stopiti v stik s svojim dodeljenim skrbnikom računa.

DOSTOPNOST INFORMACIJ

Podjetje KROCOM, d.o.o. Brežice se zavezuje, da bo uporabniku zagotavljalo informacije glede:

• Identitete podjetja (ime in sedež podjetja, matično in davčno številko),
• Kontaktnih podatkov, ki uporabniku omogočajo hitro in učinkovito komunikacijo (e-pošta, telefon),
• Bistvenih značilnosti blaga oziroma storitev, 
• Dostopnosti izdelkov (vsak izdelek, ki je v ponudbi na spletnem mestu, je dostopen v razumnem roku, z izjemo produktov iz razdelka »PREORDER« in »BACKORDER«, katerih politika je obrazložena v odstavku »PREDNAROČILA«),
• načina plačila,
• Cene izdelkov (vse navedene cene so brez DDV)
• Pritožbenega postopka.

PONUDBA ARTIKLOV IN CENE

Zaradi narave poslovanja prek spleta se ponudba in cene v spletni trgovini cubegolem.si ažurirajo in pogosto spreminjajo. Ugodnosti za registrirane člane so vezane na posameznega člana. Glede na to, da prek spletne trgovine načeloma poslujemo s poslovnimi subjekti, cene posameznih produktov, zaradi olajšanja predstave uporabnikov o neto ceni produktov, ne vključujejo DDV. Končna cena pa je skladno z ZDDV-1 prikazana tako z DDV kot brez le-tega. Cene so veljavne glede na trenutek oddaje naročila (izjema so izdelki z možnostjo »PREORDER« in »BACKORDER«, katerih politika je obrazložena v odstavku »PREDNAROČILA«) in nimajo v naprej določene veljavnosti.

NAROČILA IN CENE

Kupoprodajna pogodba med podjetjem KROCOM, d.o.o. Brežice in kupcem je v spletni trgovini cubegolem.si sklenjena v trenutku, ko podjetje KROCOM, d. o. o. Brežice (cubegolem.si) kupcu prek elektronskega sporočila ali drugače, v kolikor je tako dogovorjeno, pošlje potrdilo o naročilu, predračun ali račun (izjema so izdelki z možnostjo »PREORDER« in »BACKORDER«, katerih politika je obrazložena v odstavku »PREDNAROČILA«). Od tega trenutka so vse cene in drugi pogoji določeni.

PREDNAROČILA (ang. PREORDER) IN NAROČILA NA ZALOGO (ang. BACKORDER)

Podjetje KROCOM, d. o. o. Brežice (cubegolem.si) za določene produkte ponuja tudi možnost prednaročil oz. »PREORDER« in naročil na zalogo oz. »BACKORDER«. Pri oddaji prednaročila in naročila na zalogo (»PREORDER« in »BACKORDER«) produktov jamčite, da so vse vaše in informacije o podjetju točne, ter zagotavljate ažurnost le-teh. Podjetje KROCOM d.o.o. Brežice ne prevzema nikakršne odgovornosti za netočne informacije in si ni dolžno prizadevati za določitev pravilnih kontaktnih podatkov ali podatkov za pošiljanje. V kolikor želite svoje podatke kadarkoli spremeniti ali posodobiti, kontaktirajte svojega skrbnika računa.
 

Vsa oddana prednaročila se štejejo za zavezujoča in jih po izteku roka za prednaročilo ni mogoče preklicati.
Če ste pomotoma oddali prednaročilo in je rok za prednaročilo že potekel, se nemudoma obrnite na svojega skrbnika računa.

Prednaročila (produkti z možnostjo »PREORDER«) veljajo za izjemo, zato jih obravnavamo ločeno in za njih velja naslednja politika poslovanja:

• V primeru dodelitev (ang. allocations) s strani proizvajalcev so lahko za določitev dodelitev (ang. allocations) prednaročil upoštevani datumi, ko so bila prednaročila oddana, zato je priporočeno, da so prednaročila oddana v ustreznih rokih (pred potekom »Order Deadline«),
• Prednaročilo izdelkov ne zagotavlja, da jih boste prejeli, tudi če je bilo prednaročilo oddano v roku (»Order Dealine«),
• Ponudbe izdelkov in cene se lahko spremenijo, podjetje KROCOM, d.o.o. Brežice pa si pridržuje pravico do prilagoditve cen zaradi podražitev s strani dobaviteljev ali proizvajalcev. 
• Plačilo ob prednaročilu (naročilu produktov z možnostjo »PREORDER«) ni potrebno, razen če je pisno dogovorjeno drugače.
  
  Kupci lahko svoja prednaročila kadarkoli pred iztekom roka za naročilo pregledajo ali spremenijo v svojem uporabniškem računu pod »Your Preorders«. Po izteku roka spremembe niso več možne.

NAROČILA NA ZALOGO so izdelki, ki trenutno niso na zalogi. Ti izdelki so predvideni za dobavo v prihodnosti, vendar datumi dostave in sama dostava niso zagotovljeni. Kupci lahko svoja naročila na zalogo kadarkoli pregledajo ali spremenijo v svojem uporabniškem računu pod »Your Backorders«.

Cube Golem (podjetje KROCOM, d.o.o. Brežice) si pridržuje pravico do spremembe katerega koli od pogojev iz katerega koli razloga ali brez razloga.

POŠILJANJE

KROCOM, d.o.o. Brežice ne prevzema odgovornosti za morebitne dodatne stroške (kot so davki, carinske dajatve ali druge uvozne pristojbine), ki lahko nastanejo med postopkom pošiljanja.

Stroški pošiljanja so odvisni od lokacije dostave. Za podjetja s sedežem v EU pošiljanje organizira KROCOM, d.o.o. Brežice, pri čemer je glede na državo dostave na voljo prag za brezplačno dostavo, razen če ni dogovorjeno drugače.

Za podjetja zunaj EU KROCOM, d.o.o. Brežice ne jamči za zagotavljanje storitev pošiljanja. V takih primerih morajo kupci sami organizirati prevzem in transport blaga.

POPUSTI

Popusti prinašajo različne ugodnosti pri nakupovanju na cubegolem.si. Lahko so vezani na določenega uporabnika ali pa veljajo globalno za določene izdelke. Prosimo, upoštevajte, da se v primeru, ko je za določen izdelek na voljo več popustov, ti NE seštevajo, ampak velja LE najvišji (npr. če ima uporabnik 5 % popusta na vse izdelke, določen izdelek pa ima 10 % globalnega popusta za vse uporabnike, se pri nakupu tega izdelka upošteva 10 % popust).

POSTOPEK NAKUPA

Postopek nakupa je enak za vse registrirane uporabnike z možnostjo posebnih dogovorov. Sistem nakupa je uporabniku prijazen in ga z logičnim modelom vodi skozi postopek naročila.

POSTOPEK OBVEŠČANJA O NAKUPU

Po oddaji naročila lahko uporabniki pregledajo vsebino naročila v svojem profilu pod razdelkom »Account«. Na posredovani e-poštni naslov bo samodejno poslano potrditveno sporočilo s povzetkom naročila.

Ko skrbnik računa pregleda naročilo in potrdi količine, naročilo preide v naslednjo fazo oziroma v pakiranje. V kolikor uporabnik nima na voljo prostega ali odobrenega kreditnega limita, prejme predračun (viden v razdelku »Account«), ki ga mora poravnati pred začetkom pakiranja.

Vsi uporabniki imajo v svojem profilu (razdelek »Account«) dostop do pregleda vseh naročil in izdanih računov ter možnost spremljanja statusov svojih naročil.

Za zagotovitev točnosti dostave lahko uporabnika kontaktiramo preko navedenega e-poštnega naslova ali telefonske številke. Nadaljnja komunikacija poteka prek e-pošte ali na drug vnaprej dogovorjen način.

KREDITNI LIMIT

Izraz »kreditni limit« se nanaša na najvišji znesek kredita, ki je uporabniku na voljo za nakup izdelkov v določenem časovnem obdobju. Ta limit je določen na podlagi različnih dejavnikov, kot so plačilna disciplina in pogostost naročil.

Kreditni limit se lahko uporablja za več naročil; vendar po prekoračitvi limita ali doseženem roku plačila novi izdelki ne bodo več odposlani vnaprej, dokler odprte fakture niso poravnane.

Ob registraciji določi dodeljeni skrbnik računa višino kreditnega limita (če je odobren) ter plačilne pogoje (rok plačila).

POPUST ZA HITRO PLAČILO

Uporabniki z omogočenim kreditnim limitom so lahko upravičeni do popusta za hitro plačilo.

Popust se obračuna na skupni znesek računa, če je celotno plačilo prejeto v določenem roku od datuma računa. Za pridobitev tega popusta mora biti plačilo izvedeno znotraj določenega časovnega okvira; popust ne velja za prepozna plačila, delna plačila ali plačila, izvedena po roku zapadlosti.

Prosimo, upoštevajte, da bodo morebitne prilagoditve, vračila ali dobropisi, izvedeni po plačilu, povzročili ponovni izračun popusta, novi znesek računa pa bo odražal posodobljeno stanje.

Popusta za hitro plačilo ni mogoče kombinirati z drugimi promocijami ali popusti, razen če je to izrecno dogovorjeno v pisni obliki.

Znesek popusta in časovni okvir določita za vsakega uporabnika posebej njegov dodeljeni skrbnik računa.

VRAČILA IN REKLAMACIJE

Vračila in reklamacije sprejemamo samo v primeru naše napake. Za morebitne zahtevke se prosimo obrnite na svojega skrbnika računa.

PRAVNO OBVESTILO*

Spletna trgovina cubegolem.si in vsi podatki, slike artiklov, grafični in video elementi na spletni strani so zaščiteni in jih ni dovoljeno reproducirati ali uporabljati brez predhodnega pisnega dovoljenja podjetja KROCOM, d. o. o. Brežice.

OMEJITEV ODGOVORNOSTI

Spletna trgovina cubegolem.si se po svojih najboljših močeh trudi zagotoviti ažurnost in pravilnost podatkov, ki so objavljeni na njeni spletni strani. Kljub temu pa se lastnosti artiklov, rok dobave ali cena lahko spremenijo tako hitro, da cubegolem.si ne uspe popraviti podatkov na spletni strani. V takšnih primerih cubegolem.si naročnika obvesti o spremembah in mu omogoči odstop od pogodbe ali zamenjavo naročenega izdelka.

cubegolem.si ne odgovarja za vsebino mnenj o artiklih, ki jih napišejo obiskovalci. cubegolem.si mnenja pred objavo pregleda in zavrne tista, ki vsebujejo očitne neresnice, so neprimerna, zavajajoča ali žaljiva. cubegolem.si ne odgovarja za informacije v mnenjih in se omejuje od kakršnekoli odgovornosti, ki izvira iz podanih informacij v mnenjih.

cubegolem.si ima možnost odstopa od pogodbe le, če se ugotovi očitna napaka (46. člen OZ). Kot očitna napaka se šteje napaka v bistvenih lastnostih artikla in vse zmote, ki se po običajih v trgovini ali po namenu strank štejejo za odločilne ter jih cubegolem.si v primeru vednosti ne bi potrdil oziroma sklenil pogodbe. To vključuje tudi očitne napake v ceni.

IZKLJUČITEV ODGOVORNOSTI

KROCOM, d. o. o. Brežice si pridržuje pravico onemogočiti spletno stran ali onemogočiti dostop do nje zaradi tehničnih ali drugih težav in vzdrževanja, kar posledično pomeni tudi onemogočenje ali oviro za uporabo spletne trgovine. V primeru tehničnih težav na spletni strani si KROCOM, d. o. o. Brežice pridržuje pravico do preklica oddanih naročil, na katere je vplivala tehnična napaka. V takšnih primerih so naročniki obveščeni o preklicu v najkrajšem možnem času, hkrati pa so seznanjeni z nadaljnjimi koraki oziroma možnostmi.
